In the decision, the court notes that it is closely monitoring Russia’s military aggression against Ukraine. The court not only banned Russia from using weapons against civilian objects, but, according to the Ministry of Foreign Affairs, fully reproduced Ukraine’s fundamental demand in its statement.
For the first time in a situation of war between two states parties of the European Convention for the Protection of Human Rights and Fundamental Freedoms of Bilateral Conflict, the European Court of Human Rights in its ruling on Russia pointed to ensuring measures for only one of the parties.
The Ukrainian side has no hope that Russia will comply with these orders. At the same time, any attack on civilian infrastructure will now be a direct violation of the ECHR’s provisions, which will make it much easier to prove violations as well as recover compensation after Ukraine's victory.
It should be recalled that the International Criminal Court is to investigate war crimes in Ukraine.
